FAIRFAX COUNTY, Va. (7News) — Brendan Banfield is appealing his murder conviction in the Fairfax County au pair affair case.

A notice of appeal to the Court of Appeals of Virginia was filed Friday in Fairfax County Circuit Court, according to court records. The filing comes after Banfield was sentenced to life in prison without the possibility of parole in June.

A Fairfax County jury convicted him of the murders of his wife, Christine Banfield, and Joseph Ryan.

Prosecutors argued Banfield conspired with the family's au pair, Juliana Peres Magalhães, with whom he was having an affair, to kill his wife.

They said the pair used a fetish website while posing as Christine Banfield to lure Ryan to the family's Herndon home before staging the crime scene.

Banfield testified that he shot Ryan after finding him attacking his wife, but jurors rejected that account and found him guilty of two counts of aggravated murder, conspiracy to commit murder and child abuse.

Magalhães previously pleaded guilty to voluntary manslaughter and agreed to testify against Banfield. She was later sentenced to 10 years in prison.
