Jeanine Pirro, the U.S. Attorney for the District of Columbia, filed a lawsuit against her hometown and energy company Con Edison for $250,000 after she allegedly tripped and fell over a large wooden block.

In an amended complaint filed on Wednesday, Pirro’s attorney alleged that her injuries were directly caused by the city of Rye, New York, and Consolidated Edison Company of New York.

Pirro, who is a resident of Rye, sustained “serious personal injuries, including but not limited to bruises and contusions to the head, eye, face, and shoulder areas, together with pain, discomfort, and limitation of movement,” according to the complaint filed in the Supreme Court of the State of New York, Westchester County.

Pirro was lawfully walking on Boston Post Road at, or near, the intersection of Purchase Street and Cross Street on or about August 28, 2025, when this incident occurred, according to the complaint.

She tripped and fell over a wooden block “embedded in and protruding from under a steel plate” covering an excavation in the roadway, according to the lawsuit. The complaint alleged that this constituted “a hazardous, defective, dangerous, and unsafe condition.”

“The hazardous condition over which Ms. Pirro fell was caused by, arose out of, and was directly related to Con Edison’s construction and excavation activities, including the placement, use, and failure to properly secure the construction site for pedestrian traffic, and to remove or secure construction materials and the failure to restore the roadway to a safe and level condition,” Albert J. Pirro Jr., Jeanine Pirro’s attorney, said in the complaint.

The lawsuit alleged that the “dangerous condition” also arose from “acts of negligence by the City of Rye in the performance and oversight of construction and roadway work and its breach of its duties to properly inspect and secure the roadway for pedestrians.”

She had no prior notice of the “dangerous condition” and could not reasonably have avoided it, her attorney said.

In an answer and cross-complaint filed last month, attorneys for Con Edison denied allegations made in Pirro's original complaint. The defendants have not yet responded to the amended complaint.
